This Privacy Policy explains how Blue Origin Enterprises, L.P. and its subsidiaries and affiliated companies, including Blue Origin, LLC, Blue Origin Alabama, LLC, , Blue Origin Florida, LLC, Blue Origin Management, LLC, Blue Origin Texas, LLC, Blue Origin International, LLC, Honeybee Robotics, LLC, and Casting Operations, LLC (referred together as “Blue Origin”) collect, use, and disclose information about you when you access or use Blue Origin’s website (www.blueorigin.com or www.honeybeerobotics.com), Blue Origin’s supplier portals, Blue Origin’s online store (www.shop.blueorigin.com/), and Blue Origin’s other online products and services that link to this policy (hereinafter referred to as "Services"). If you have any comments or questions about Blue Origin’s privacy policies, please contact Blue Origin at privacy@blueorigin.com.

Blue Origin may change this Privacy Policy from time to time. If Blue Origin makes changes, Blue Origin will notify you by revising the date at the top of the policy and, in some cases, Blue Origin may provide you with additional notice (such as adding a statement to Blue Origin’s homepage or sending you a notification). Blue Origin encourages you to review the Privacy Policy whenever you access the Services or otherwise interact with Blue Origin to stay informed about Blue Origin’s information practices and the choices available to you.

Collection of Information

Information You Provide to Blue Origin

Blue Origin collects information that you provide directly to Blue Origin, such as when you sign up for Blue Origin’s mailing lists, enter information into Blue Origin’s customer and supplier portals, and contact Blue Origin to learn more about becoming an astronaut or supplier. Blue Origin also collects information that you may provide or input through the Services when you fill out a form, participate in a contest or promotion, submit media inquiries, send Blue Origin comments or questions, make a purchase through Blue Origin’s online store, apply to be an astronaut or purchase a seat on one of Blue Origin’s spacecraft, communicate with Blue Origin via third party social media sites, request customer support, or otherwise interact with Blue Origin. The types of information Blue Origin may collect include your name, postal address, phone or fax number, email address, demographic information, the name of the company or organization you belong to, country of residence, payment information, interests, and any other information you provide to Blue Origin. Sensitive health information disclosed herein may be stored or transmitted in connection with company operations.

In addition to the information disclosed above, when you apply to be a Blue Origin astronaut through Blue Origin’s Astronaut Portal, Blue Origin collects additional information about you including your height, weight, date of birth, gender, and passport or government identifier information.

Automatically Collected Information

When you access or use Blue Origin’s Services, Blue Origin automatically collects information about you, including:

  • Transactional Information: When you make a purchase or return, including from Blue Origin’s store, Blue Origin collects information about the transaction, including order details such as items purchased, purchase price, and the date and location of the transaction.

  • Log Information: Blue Origin collects log information about your use of the Services, including the type of browser you use, access times, pages viewed, your IP address, and the page you visited before navigating to Blue Origin’s Services.

  • Device Information: Blue Origin collects information about the computer or mobile device you use to access Blue Origin’s Services, including the hardware model, operating system and version, and unique device identifiers.

  • Information Collected by Cookies and Other Tracking Technologies: Blue Origin uses different technologies to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in device memory that help Blue Origin improve its Services and your experience, see which areas and features of Blue Origin’s Services are popular, and count visits. Web beacons are electronic images that may be used in Blue Origin’s Services or emails and help deliver cookies, and count visits to help Blue Origin understand usage and campaign effectiveness. Information Blue Origin Collects from Other Sources

Blue Origin may obtain information about you from other sources such as social media sites, identity verification services, data analytics providers, and data enrichment providers. Additionally, if you communicate with Blue Origin through a social media site, Blue Origin will have access to certain information from Blue Origin’s interactions with you on that site, such as your name and any profile information you make available to Blue Origin, in accordance with the authorization procedures determined by such social media site.

In addition, when you use the Amazon Alexa skill for Blue Origin, Blue Origin receives some limited information from Amazon about your interactions with the skill. This includes your email address (if you authorized them to provide this), certain anonymized data and analytics regarding the skill, parsed response text, and your device ID. Note that your voice interactions with the skill are captured directly by Amazon, not by Blue Origin, and are governed by Amazon’s Privacy Notice and the Alexa Terms of Use and not this privacy policy.

Use of Information

Blue Origin uses the information Blue Origin collects about you to provide, maintain, and improve its Services, as well as to provide you with information you request, process your employment applications, send you materials as a part of Blue Origin’s mailing list, if you elect to participate, and evaluate your eligibility to participate in a flight. Blue Origin also uses information about you to:

  • Send you technical notices, notifications, updates, security alerts, support and administrative messages, and to respond to your comments, questions and customer service requests;

  • Process transactions and send you related information, including fulfilling your purchases from Blue Origin’s online store, sending you confirmations and invoices, and facilitating returns or exchanges;

  • Communicate with you about Blue Origin, New Glenn, Engines, New Shepard, and other programs, opportunities, products, services, offers, promotions, rewards, and events offered by Blue Origin, and provide news and information Blue Origin thinks will be of interest to you;

  • Monitor and analyze trends, usage and activities in connection with Blue Origin’s Services;

  • Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of Blue Origin and others;

  • Facilitate contests, sweepstakes, and promotions, and process and deliver entries and rewards;

  • Personalize and improve the Services and provide advertisements, content, or features that match user profiles or interests through Blue Origin’s third-party advertising service providers; and

  • Carry out any other purpose described to you at the time the information was collected.

Sharing of Information

Blue Origin may share information about you as follows or as otherwise described in this Privacy Policy:

  • With vendors, consultants, and other service providers who need access to such information to carry out work on Blue Origin’s behalf such as companies that assist use with web hosting, data enrichment, payment processing, and analytics;

  • With Blue Origin’s lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage Blue Origin’s business interests as well as with government agencies and professional regulators where permitted or required to comply with Blue Origin’s legal obligations;

  • In response to a request for information if Blue Origin believes disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;

  • If Blue Origin believes your actions are inconsistent with Blue Origin’s user agreements or policies, or to protect the rights, property and safety of Blue Origin or others;

  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of Blue Origin’s business by another company;

  • Between and among Blue Origin and Blue Origin’s current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and

  • With your consent or at your direction.

Blue Origin may also share aggregated or de-identified information, which cannot reasonably be used to identify you.

Advertising and Analytics Services Provided by Others

Blue Origin engages others to provide analytics services, serve advertisements, and provide related services on Blue Origin’s behalf across the web. These entities may use cookies, web beacons, device identifiers and other technologies to collect information about your use of the Services and other websites and applications, including your IP address, web browser, pages viewed, time spent on pages, links clicked, and conversion information. This information is used by Blue Origin and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on other companies’ websites, and better understand your online activity.  For more information about interest-based ads, or to opt out of having your web browsing information used for behavioral advertising purposes, please visit www.aboutads.info/choices or http://www.youronlinechoices.eu/ if you are an EU resident.

Blue Origin also works with third party service providers to serve ads to you as part of customized campaigns on third-party platforms (such as LinkedIn). As part of these ad campaigns, Blue Origin or the third-party platforms may convert information about you, such as your email address, into a unique value that can be matched with a user account on these platforms to allow Blue Origin to learn about your interests and serve you advertising that is customized to your interests. Note that the third-party platforms may offer you choices about whether you see these types of customized ads.

Data Retention

Blue Origin stores the information Blue Origin collects about you for as long as is necessary for the purpose(s) for which Blue Origin originally collected it or for other legitimate business purposes, including to meet Blue Origin’s legal, regulatory, or other compliance obligations.

Users Around the Globe

Blue Origin processes and stores information in the United States. As such, Blue Origin and its service providers may transfer your information to, or store or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. Blue Origin will take steps to ensure that information about you receives an adequate level of protection in the jurisdictions in which Blue Origin processes it.

When Blue Origin transfers personal data from the European Union, the United Kingdom, or Switzerland to the United States, Blue Origin complies with the EU-U.S. Data Privacy Framework, the UK Extension, and the Swiss - U.S. Data Privacy Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data transferred from the European Union, the United Kingdom, and Switzerland to the United States, respectively. Blue Origin has certified to the Department of Commerce that it adheres to the Data Privacy Framework Principles with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from Switzerland, and the United Kingdom (and Gibraltar) in reliance on the UK and Swiss Extensions to the EU-U.S. DPF.  If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF and Swiss and UK Extension to the EU-U.S. DPF Principles, the Principles shall govern. Moreover, Blue Origin may establish alternative grounds for transferring personal data, depending on the particular data flows, such as the execution of Standard Contractual Clauses.

In compliance with the Data Privacy Framework Principles, Blue Origin is committed to resolving complaints about its processing of your personal data. EU, United Kingdom, and Swiss individuals with inquiries or complaints regarding Blue Origin’s compliance with the Data Privacy Framework program should first contact Blue Origin. Blue Origin has further committed to refer unresolved Data Privacy Framework complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from Blue Origin, or if Blue Origin has not addressed your complaint to your satisfaction, please contact or visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you.

Blue Origin’s accountability for personal data that it receives under the DPF and subsequently transfers to a third party is described in the DPF Principles. Blue Origin remains responsible and liable under the DPF Principles if Blue Origin’s third-party agents process personal data on Blue Origin’s behalf in a manner inconsistent with the Principles, unless Blue Origin demonstrates that it is not responsible for the event giving rise to the damage.

Under certain conditions, you may be able to invoke binding arbitration to resolve your complaint. Blue Origin is subject to the investigatory and enforcement powers of the U.S. Department of Transportation. If Blue Origin shares personal data transferred to the U.S. under the Data Privacy Framework with a third-party service provider that processes such data on Blue Origin’s behalf, then Blue Origin will be liable for that third party’s processing in violation of the Data Privacy Framework Principles, unless Blue Origin can prove that Blue Origin is not responsible for the event giving rise to the damage.

The Department of Transportation has jurisdiction over Blue Origin’s compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the Swiss and UK Extensions to the EU-U.S. DPF. In certain situations, Blue Origin may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Your Choices

Account Information

You may review and update information about you by contacting Blue Origin at privacy@blueorigin.com. Please note that Blue Origin may retain certain information as required by law or for legitimate business purposes. Blue Origin may also retain cached or archived copies of information about you for a certain period of time.

Cookies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of Blue Origin’s Services.

Promotional Communications

You may opt-out of receiving promotional emails from Blue Origin by following the instructions at the bottom of those emails or by contacting Blue Origin with your request at privacy@blueorigin.com. If you opt-out, Blue Origin may still send you non-promotional emails, such as those about your account or our ongoing business relations.

Residents of the European Economic Area, The United Kingdom, and Switzerland

Legal Basis for Processing

If you are in the EEA, the United Kingdom, or Switzerland, when Blue Origin processes personal data about you, Blue Origin will only do so in the following situations:

  • Blue Origin needs to use personal data about you to perform its responsibilities under Blue Origin’s contract with you. For example, Blue Origin may use your payment information to process payments for providing the products or services you have requested.

  • Blue Origin has a legitimate interest in processing personal data about you. For example, Blue Origin may process personal data about you to provide, secure, and improve Blue Origin’s Services.

  • Blue Origin has your consent to do so. For example, with your consent, Blue Origin may add you to its newsletter and send you regular updates on programs that you are interested in including Blue Origin, New Glenn, Engines, and New Shepard.

  • Blue Origin needs to process personal data about you in accordance with legal obligations it has.

Data Subject Requests

If you are in the EEA, United Kingdom, or Switzerland, you have the right to access personal data Blue Origin holds about you and to ask that your personal data be corrected, erased, or transferred. You may also have the right to object to, or request that Blue Origin restrict, certain processing. If you would like to exercise any of these rights, you may contact Blue Origin as indicated below.

Your California Privacy Rights

The California Consumer Privacy Act or “CCPA” (Cal. Civ. Code § 1798.100 et seq.) affords consumers residing in California certain rights with respect to their personal information and requires Blue Origin to explain that to you using certain definitions and categories. If you are a California resident, this section applies to you and describes Blue Origin’s data practices today and in the preceding 12 months.

Categories and Sources of Personal Information: In the past 12 months, Blue Origin collected the following categories of personal information: identifiers (such as a name, email address, and device identifiers); demographic information (such as age or gender); commercial Information (such as purchase history); internet or electronic network activity information (such as browsing and usage data); and inferences (such as approximate location).

Business or Commercial Purpose for Collecting Personal Data: Blue Origin collects this personal information for the business and commercial purposes described in “Use of Information” above.

Blue Origin does not use or disclose sensitive personal information for the purpose of inferring characteristics about you.

Sales of Personal Data: Blue Origin does not sell your personal information. Blue Origin does allow third party service providers to collect certain device identifiers and internet and electronic network activity via Blue Origin’s Services to show ads that are targeted to your interests. Please see the “Advertising and Analytics Services Provided by Others” section above for more details or for information on how to opt out of these activities.

CCPA Consumer Rights: Subject to certain limitations, you have the right to (1) request to know more about the categories and specific pieces of personal information Blue Origin collects, uses, and discloses, (2) request deletion of your personal information, (3) opt out of any “sales” of your personal information that may be occurring, (4) correct inaccurate personal information that Blue Origin maintains about you, (5) limit the use and disclosure of sensitive information Blue Origin maintains about you, subject to certain limitations, and (5) not be discriminated against for exercising these rights. You may make these requests by emailing Blue Origin at privacy@blueorigin.com. Blue Origin will verify your request by asking you to provide information related to your recent interactions with Blue Origin, such as a recent purchase you made, or a recent interaction Blue Origin had with you that Blue Origin can use to clearly verify your identity. Blue Origin will not discriminate against you if you exercise your rights under the CCPA. 

Please refer to the “Any Questions” section below to submit a rights request. Blue Origin will verify your request including by asking you to provide information that matches information Blue Origin has on file about you. You can also designate an authorized agent to exercise these rights on your behalf, but Blue Origin will require proof that the person has been authorized and may still ask you to verify your identity with Blue Origin directly.

If you are submitting a rights request as an authorized agent, you are required to submit proof of your authorization to make the request, such as a valid power of attorney or proof that you have signed permission from the individual who is the subject of the request. Please do not provide any sensitive personal information in connection with this request, such as a driver's license or other government-issued ID. In some cases, Blue Origin may be required to contact the individual who is the subject of the request to verify his or her own identity or confirm you have permission to submit this request.
